Child Name Change Process

Step 1 - Free Consultation

The first step to our child name change process is contacting us. You can call, text, or email us for a free 15-minute child name change consultation over the telephone. During this time, we will ask you a few questions to determine what your next steps are, and we will answer any questions you may have. During the consultation, you will be made aware of any documents necessary for your child’s legal name change. These documents often include birth certificate, social security card, prior court orders, passport, and other official government documents. After the consultation, you can set an appointment to get started.

Step 2 - Appointment with Attorney

We see clients Monday-Friday between 10 a.m. and 5 p.m. at our conveniently located office. At your appointment, you will discuss your child’s name change with your attorney, who will create all necessary legal documents. At the end of your appointment, you will sign the documents with our on-site notary and provide payment. After the appointment, your attorney will file the documents and usher your child’s legal name change through the District Court. 

Step 3 - Court Hearing

Once your attorney has filed the necessary court documents, you and your attorney will attend a child name change hearing to present your case to the judge.* You will be sworn in and the attorney will guide you through questions about your case. Your attorney will make any necessary arguments before the judge to further your case. Only one parent or guardian must attend the court hearing for uncontested matters. 

*Contested cases may require additional work before the hearing. Under Covid rules, an in-person hearing may not be required.

 

Step 4 - Updating Records

Once the Court grants your child’s name change, your attorney will obtain and provide certified copies of your court order. Your attorney will provide you with instructions and all documentation necessary for updating your child’s birth certificate, social security card, passport, and driver's license, as applicable.

$950 Flat Rate
  • This package is for when all parents, guardians, and/or conservators agree, but not everyone can attend the client-attorney appointment.

Child Has No Legal or Presumed Father

$1,050 Starting Rate
  • This package is for when the child has no legal or presumed father, and does not have a court-appointed guardian or conservator.
  • If the judge agrees that no other person needs to be involved, the total cost will be $1,050.
  • If the judge decides that another person needs to be involved, the matter will be considered Contested and charged under the Contested Plan if that person cannot or will not sign in agreement.

$2,000 Retainer

Reasons Our Clients Change Their Childrens' Names
