Family Name Change Guide

Step 1 - Free Consultation

The first step to our family name change process is contacting us. You can call, text, or email us for a free 15-minute family name change consultation over the telephone. During this call, we will go through a few questions to determine what the next steps are, and we will answer any questions you have. At this time, you will be made aware of the documents needed for your family’s legal name change. These often include birth certificates, social security cards, prior court orders, passports, and other official government documents. After the consultation, you can set an appointment to begin the legal proceedings.

Step 2 - Appointment with Attorney

We see clients Monday-Friday between 9 a.m. and 5 p.m. at our conveniently located office. During the appointment, you will discuss your family name change with the attorney, who will create all necessary legal documents. At the end of your appointment, you will sign the documents with our on-site notary and provide payment. After the appointment, your attorney will file the documents and usher your family’s legal name change through the District Court.

Step 3 - Court Hearing

Once your attorney has filed the necessary court documents, your attorney will present your case to the judge. Depending on the facts of your case, you may need to attend a court hearing in person or on Zoom. If a hearing is required, all adults seeking a name change should be present for the hearing, and children should have at least one parent or legal guardian present.

Step 4 - Updating Records

Once the court grants your family’s name change, your attorney will obtain and provide certified copies of your court order. Your attorney will also provide you with instructions and completed documentation necessary for updating your family’s birth certificates, social security cards, passports, and other government identity documents, as necessary.

Reasons For a Family Name Change

Changing to a Biological Parent's Surname

Changing to a Step-Parent's Surname

Many of our clients were raised by a step-parent and feel that their step-parent's name better represents their family rather than the name of a person who was less involved in their lives. Preference for New Name

Religous or Cultural Reasons
